  • Provide accurate business and contact information.
  • Keep account credentials and verification codes secure.
  • Restrict account access to authorised personnel.
  • Notify FirSe of suspected unauthorised access.
  • Ensure your staff follow these terms.

You must not impersonate another business, provide misleading information or use FirSe for unlawful purposes.

Customers sign in with a mobile number verified by a one-time password (OTP) sent by SMS.

Customers under 18 may use FirSe only with the consent and supervision of a parent or guardian. Business accounts must be opened by an adult who is authorised to act for the business.

3. Initial Free Access

FirSe is intended to be offered free during its initial launch period.

  • No subscription fee will be charged for features offered as free during this period.
  • FirSe may introduce paid plans in the future.
  • Before activating a paid plan, FirSe will disclose the applicable price, billing frequency and material terms and obtain your agreement.
  • Access to early-release features may change as FirSe develops.

The initial free period lasts 3 months, starting from [START OF FREE PERIOD, e.g. the date your account is activated]. Eligibility conditions for the free period are an amount confirmed at the time of the claim.

4. Loyalty Programmes

Each participating business is responsible for setting its own:

  • Stamp requirements.
  • Eligible visits or purchases.
  • Rewards and redemption conditions.
  • Expiry rules, if any.
  • Other programme restrictions.

Businesses must communicate these rules clearly to customers before or when they join.

Businesses must honour valid rewards earned under the applicable programme rules. They must not arbitrarily remove earned stamps or change reward conditions retrospectively.

If a programme changes or ends, the business must provide reasonable notice and explain how customers can use valid stamps and rewards already earned, subject to applicable law.

FirSe provides the technology to manage loyalty programmes. Unless separately agreed in writing, FirSe does not supply or fund the rewards promised by businesses.

Businesses must comply with applicable laws when running their loyalty programmes, including consumer protection, advertising and tax laws.

5. Stamps and Reward Accuracy

A stamp is created only when a customer scans the business’s FirSe code and the merchant or their authorised staff then approves it. No stamp is recorded without that approval.

Businesses are responsible for ensuring that stamps are recorded accurately and only for eligible activity. They must not create fraudulent stamps, manipulate redemptions or mislead customers about their rewards.

If a customer reports a missing stamp, incorrect record or failed redemption, the business should review the issue. FirSe may assist with technical investigations where relevant.

FirSe may correct verified technical errors and may temporarily restrict affected transactions or accounts where reasonably necessary to investigate suspected fraud, misuse or security issues.

6. Customer Use

Stamps and rewards have no cash value. They cannot be exchanged for cash, transferred or sold, and can be redeemed only at the business that issued them, under that business's programme rules.

Customers must not:

  • Collect stamps without a genuine eligible visit or purchase.
  • Attempt to have a stamp approved by misrepresenting a visit or purchase.
  • Create or use more than one account to collect stamps.
  • Misuse a loyalty programme in any other way.

FirSe or the business may remove stamps or rewards obtained in breach of these rules and may suspend the account involved.

7. Customer Information

FirSe may process customer information needed to operate the loyalty platform, including information provided during sign-up and records of stamps, visits and rewards.

Businesses must:

  • Use customer information only for authorised and disclosed purposes.
  • Provide any notices and obtain any consent required for their activities.
  • Protect information accessed through their accounts.
  • Not sell, misuse or disclose customer information unlawfully.
  • Respect applicable requests to correct or delete personal data.

Businesses must not use FirSe to send unsolicited marketing communications. FirSe's current MVP does not include promotional messaging.

Further information is provided in the FirSe Privacy Policy.

8. Acceptable Use

You must not use FirSe to:

  • Commit fraud or engage in unlawful activity.
  • Create fake visits, purchases, stamps or redemptions.
  • Access another business's information without authorisation.
  • Interfere with the security or operation of FirSe.
  • Upload unlawful content or information you are not authorised to use.
  • Infringe intellectual property or other legal rights.

FirSe may investigate suspected violations and take proportionate action.

9. Intellectual Property

FirSe and its licensors retain rights in the platform, software, design, branding and related materials, except for third-party materials.

Businesses retain ownership of their own names, logos and content. Businesses grant FirSe permission to use those materials as reasonably necessary to operate and display their loyalty programmes.

Businesses must have the rights required to submit and use their materials.

10. Service Availability

FirSe aims to provide a reliable service but does not guarantee uninterrupted availability or error-free operation.

Maintenance, technical issues, security incidents or operational requirements may temporarily affect the service.

FirSe will take reasonable steps to investigate reported technical problems and correct verified errors.

11. Suspension and Termination

Businesses may stop using FirSe and request account closure by contacting Instagram @firseapp.

FirSe may suspend or terminate access for serious or repeated breaches, suspected fraud, security risks, legal requirements or discontinuation of the service.

Where practicable, FirSe will provide notice and an opportunity to address the issue. Immediate action may be necessary to address serious risks.

Account closure does not automatically remove obligations concerning valid rewards already earned. Businesses remain responsible for those obligations under their programme rules and applicable law.

Personal data will be handled following the Privacy Policy and applicable law.

12. Disclaimers and Liability

FirSe does not guarantee that using the platform will increase sales, customer retention or business revenue.

To the extent permitted by applicable law, FirSe does not guarantee uninterrupted or error-free service.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

FirSe is not responsible for disputes between a customer and a business about a reward, offer or stamp. Such disputes are between the customer and the business.

To the extent permitted by applicable law, FirSe's total liability for any claim relating to the service is limited to the fees you paid to FirSe in the 12 months before the claim. No fees are charged during the free period.

13. Changes to These Terms

FirSe may update these terms to reflect changes in its services, operations or applicable law.

The revised version will display an updated date. Where required or appropriate, FirSe will provide notice of material changes and obtain fresh agreement where legally necessary.

14. Governing Law

The appropriate jurisdiction for disputes is the courts of Belagavi, Karnataka.
